1. Agreement and eligibility
By creating an account, purchasing a plan, using the dashboard, or using any CloudyMax service, you agree to these Terms and our Privacy Policy.
You may use CloudyMax only if you are at least 18 years old, or the age of majority in your location, and you are legally allowed to use the service.
2. What CloudyMax provides
CloudyMax provides account-based network security services, protected network access, secure billing, guided setup, fair-use monitoring, refresh tools, and customer support.
We may add, change, pause, or discontinue features when needed for security, availability, payment compliance, or service quality.
3. Accounts and security
You are responsible for providing accurate account information, keeping your password secure, and notifying support if you believe your account has been compromised.
CloudyMax may pause or review accounts that appear compromised, resold, shared for commercial abuse, involved in fraud, or used in a way that creates risk for the service, other users, or third parties.
4. Plans, unlimited data, and payments
Plans provide unlimited data access for normal personal use during the selected validity period. We monitor unusual or abusive use under our Fair Use and Acceptable Use rules, but internal review levels are not automatic data cutoffs.
A successful payment activates account-specific protected access. Failed, cancelled, reversed, or expired payments may not activate service.
Unless the checkout page clearly says otherwise, CloudyMax plans are sold as one-time prepaid purchases for the selected duration and do not renew automatically.
Gaming, development-board, dedicated-IP, router, and business solutions may require a compatibility review and written quote before payment. Availability is not confirmed until CloudyMax approves the requested device, location, and setup.
5. Refunds and cancellations
Refund requests may be reviewed case by case for duplicate payments, checkout errors, activation failures, or other support-confirmed issues.
Refunds may be denied for fraud, abuse, chargeback misuse, terms violations, excessive completed usage, or payment methods that cannot be refunded by the provider.
6. Acceptable use
You must not use CloudyMax for unlawful, harmful, abusive, or high-risk activity.
- Spam, phishing, scams, impersonation, or credential theft.
- Malware, botnets, ransomware, unauthorized access, or network attacks.
- Harassment, threats, stalking, exploitation, or harm to minors.
- Copyright infringement, intellectual-property violations, or illegal content distribution.
- Payment fraud, identity theft, chargeback abuse, or attempts to bypass billing controls.
- Activities prohibited by sanctions, export controls, payment-network rules, or applicable law.
7. Compliance and restricted access
You are responsible for understanding and following the laws that apply to you. CloudyMax does not authorize illegal activity.
We may refuse, pause, restrict, or terminate access when required by law, sanctions, payment-provider rules, security review, abuse prevention, or operational risk management.
8. Support access
Authorized support staff may access customer accounts only when needed to help with support, billing, activation, or security review. Support access is restricted and recorded for audit purposes.
9. Third-party services
CloudyMax may work with payment processors, email providers, hosting providers, security tools, and other service providers. These providers have their own terms, privacy notices, availability limits, and compliance rules.
10. Availability and limitations
We work to keep CloudyMax reliable, but we do not guarantee that the service will be uninterrupted, error-free, available on every network, or compatible with every device or third-party platform.
Performance may vary because of device settings, local networks, third-party platforms, internet providers, regional restrictions, maintenance, or events outside our control.
11. Intellectual property
CloudyMax, including its name, logo, website, text, design, software, and related materials, is owned by CloudyMax or its licensors. You may not copy, resell, reverse engineer, or misuse our materials except where allowed by law.
12. Suspension and termination
We may suspend or terminate access if you violate these Terms, create security or abuse risk, fail payment review, reverse a payment, or if continuing service would expose CloudyMax, users, or third parties to risk.
13. Disclaimers and liability
CloudyMax is provided on an as-is and as-available basis to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and uninterrupted operation.
To the fullest extent permitted by law, CloudyMax will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, lost profits, service interruption, or unauthorized access.
14. Changes and contact
We may update these Terms as the service changes. The latest version will be published on this page.
Questions about these Terms may be sent to support@cloudymax.com.
